The Legal Complexities of Resident Screening in California
California law has gotten increasingly more complex and stringent over the past few years
If you're a new landlord, an out-of-state investor, or just need to brush up on your legal knowledge, you might not realize how much you have to keep track of to ensure legal compliance with resident screening alone.
Here are just a few of the legal guidelines we take care of for you when screening and processing applications:
- Fair Housing laws bring further considerations and risks for screening, particularly in California, which has 14 protected classes in addition the 7 federally protected classes.
- AB 2493, effective January 1st, 2025, provides two very strict options for processing resident applications in California. Landlords and property managers can either A. Process applications in the order they are received, accepting the first qualified application or B. Refund all application fees to rejected applicants. - Under Senate Bill 329, California landlords must accept applicants with housing vouchers like Section 8. Senate Bill 267 further states that credit reports cannot be used to decide whether to accept an applicant with housing vouchers. We use the appropriate alternative methods always for these applications.
- Also per SB 329, you must provide applicants with a written, itemized receipt of their application fee.
- Per California Civil Code §§ 1950.6, if a Landlord obtains a credit report during screening, the rental application must allow the applicant to request a copy of their credit report, and if selected, the Landlord must provide a copy to the applicant.
- The application process can be even more complicated if the applicant has a service animal or emotional support animal, which cannot be rejected. However, we have documented and proven processes for handling assistance animal requests.
- Many landlords in the local market are unaware of the Fair Credit Reporting Act, or think that it does not apply to Landlords. It does, and we take these guidelines very seriously.
